What is this role about?
The role will execute end-to-end disciplinary case management activities and provide assistance during DOLE inspection audits. He/she will develop and execute ER-owned policies and special projects, necessary to ensure compliance with labor laws and company policies.
On a day-to-day basis, the role will be responsible for: data gathering with the employees involved in a case; assessment of cases and formulation of recommended resolution; creation of case reports and documentations; and meeting and alignment with teams involved in the case.
Through well-managed employee relations, the role will contribute to the efficient accomplishment of company goals and objectives.
What will YOU do?
Investigate all assigned employee complaints and incidents reports, such as policy violations, harassment, fraud, etc., and recommend resolutions for ER Manager's approval. To ensure that all facts necessary for the resolution of the case are taken into consideration, and that the decisions to be made are accurate and not discriminatory of any of the employees' rights, the following activities will be undertaken:
Interview managers and other employees to gather additional information about the case.
Review company rules and policies that have been violated by the employees.
Assess the nature and severity of the complaint.
Recommend the offenses violated and the penalties to be imposed, in case employees are found violative of the company rules; and work closely with Legal, HR-Organizational Effectiveness (HR-OE), and CMOC to conduct a complete and fair investigation of the concerned.
Maintain confidentiality through the process.
Prepare notices and other documentations for HR and legal review. To ensure due process, the following activities will be undertaken:
Prepare Notice to Explain (NTE).
Schedule administrative conferences for specific violations.
Prepare Notice of Decision (NOD).
Prepare other documentations as may be required during the process, such as resolutions, notice of hearing, notice of preventive suspension, and notice of final decision on appeal.
Facilitate the end-to-end processing of disciplinary cases. To ensure due process, the following activities will be undertaken:
Send notices and secure acknowledgments from employees.
Prepare minutes of meetings to capture discussions and approvals of CMOC.
Send complete disciplinary actions (DA) case documents to HR for 201 filing once the case is closed.
Communicate decisions to immediate managers and employees concerned.
Analyze and report information related to the disciplinary process. To ensure that all facts being considered when making decisions for disciplinary cases are accurate and complete, the following activities will be undertaken:
Know the company rules by heart.
Gather all relevant company policies.
Create and update employee relations policies and procedures. To ensure that we keep abreast with the recent development in business, legal requirements, company directions, among others, the following activities will be undertaken:
Review the internal processes and make recommendations for improvement.
Coordinate with the Business Unit (BU) heads and include newly-implemented policies in the company rules.
Research new laws that may have effects on how we do business.
Execute compliance requirements mandated by DOLE and assist during DOLE labor case hearings (DOLE SENA), and mandatory conferences. TO ensure closure of DOLE labor cases and inspection of audit findings and company's compliance to labor laws and policies, the following activities will be undertaken:
Coordinate closely with the DOLE inspectors to ensure that we meet all of their requirements in a timely manner.
Compile all DOLE-related documentation requirements, and ensure that they are available and readily-accessible, when needed.
Review and follow through on execution of all disciplinary actions. To ensure the timely closure of all disciplinary cases, a calendar of activities shall be created.
Monitor and maintain discipline and labor compliance tracking system. TO be able to monitor the complete disciplinary and labor compliance process, the following activities shall be undertaken:
Manage and maintain a centralized database of disciplinary cases and DOLE audits.
Work with HR-OE to analyze employee relations case trends.
Perform other functions that may be assigned from time to time.
What will YOU need?
Graduate of a four-year course relating to HRM, Industrial Organization Psychology, Behavioral Arts, Management, or its equivalent, from reputable universities
At least 5 - 6 years of related professional experience, preferably from the manufacturing, retail, oil/gas industries, and with at least 1 year of supervisory experience
Must be willing to do fieldwork as needed
Adept in data analysis, employee/labor laws/relations
Demonstrate strong teamwork, time management, adaptability, problem-solving, work ethics, collaboration, and decision making skills.
Above average verbal and written communication skills.
